Terms of Use — QuickRoomFinder

1. Definitions
"Service" — the QuickRoomFinder application available at qr.kioskware.co, enabling real-time conference room availability monitoring.
"Provider" — Kioskware Sp. z o.o., registered in Warsaw, Poland, NIP: PL1133179599, REGON: 542748842, KRS: 0001195005.
"User" — any individual or legal entity using the Service.
"Administrator" — a User with administrator privileges in their organization.
"Kiosk" — a device displaying room availability information to employees.
"Subscription" — a paid licensing plan enabling use of the Service.
2. General Terms
By using the Service, you accept these Terms of Use. The Service is intended for business use only. The User agrees to use the Service in accordance with applicable law, these Terms, technical documentation, and the security rules of the User's organization. In particular, the User must not attempt unauthorized access, bypass security controls, disrupt the Service, test vulnerabilities without the Provider's written consent, introduce malicious code, obtain data without authorization, or use the Service in a way that infringes third-party rights. The Provider reserves the right to modify these Terms — Users will be notified of material changes via email with 14 days' notice.
3. Registration and Account
Access to the Service requires authentication via an external identity provider (Cisco Webex, Google, or Microsoft 365). The Provider does not store User passwords. The Administrator is responsible for managing user access within their organization. Each organization configures the integration independently using the setup wizard.
4. Licenses and Payments
The Service is available on a subscription basis. Licenses are assigned to video terminals and kiosks. Prices are quoted in EUR, PLN, or USD (net, excluding VAT). Online payments are processed by Paddle.com Market Ltd, which acts as the Merchant of Record. Paddle is responsible for payment processing, tax collection, and invoicing for online transactions. Subscriptions renew automatically unless cancelled before the end of the current billing period. In some cases, subscription sales may also take place directly from the Provider or through an authorized reseller other than Paddle. Consumers may have withdrawal, cancellation, refund, or other mandatory consumer rights in the scope and time limits required by the laws of the country where the transaction is made; the detailed rules, including country-specific terms applied by Paddle as Merchant of Record, are described in Paddle's Buyer Terms (paddle.com/legal/checkout-buyer-terms). The Provider reserves the right to change pricing. In that case, the Provider will inform customers at least 30 days in advance.
5. Trial Period
New Users may use a free 30-day trial period. The trial does not require payment details. After the trial period, a subscription purchase is required to continue using the Service.
6. Limitation of Liability
The Provider makes reasonable efforts to ensure continuity and correctness of the Service but does not guarantee uninterrupted availability. The Provider is not liable for:
— outages due to maintenance or updates,
— errors resulting from incorrect integration configuration by the User,
— data loss caused by third parties or force majeure,
— business decisions made based on data presented by the Service,
— failures or unavailability of the Cisco Webex platform or its API,
— failures of User devices, including kiosks (hardware and software), video terminals, and end-user devices,
— internet connectivity issues on the User's side.
Data presented by the Service is sourced from the Cisco Webex API and other external sources. The Provider does not guarantee its accuracy, completeness, or timeliness. The Service provides tools intended to help configure operation in line with laws applicable in different countries and with the Customer organization's internal policies, including settings for data visibility, integrations, licenses, and communications. These tools may be insufficient for a particular jurisdiction, industry, or organization. The Administrator is responsible for assessing legal and company requirements, configuring the Service correctly, and maintaining compliance over time. If compliance cannot be ensured in a given case, the Customer must not use the Service in that scope.
7. Data Protection
The Provider processes personal data in accordance with Regulation (EU) 2016/679 (GDPR). Detailed information about personal data processing is available in the Privacy Policy.
8. Security
Communication with the Service is encrypted (HTTPS/TLS). Sensitive data is encrypted using AES-256-GCM. The Service uses official authentication mechanisms of external identity providers (Cisco Webex, Google, Microsoft 365 — OAuth 2.0) and does not store user passwords.
9. Intellectual Property
The Service, its source code, user interface, logo, and the "QuickRoomFinder" name are the intellectual property of the Provider. QuickRoomFinder was created with the assistance of AI tools. The names Cisco, Webex, Cisco Webex, Webex Room, Cisco Room, RoomOS, and related trademarks or product names belong to Cisco Systems, Inc. or its affiliates. Their use in the Service is informational and descriptive, indicates technical integration or compatibility, and does not imply sponsorship, endorsement, or partnership with Cisco unless expressly stated otherwise. The User receives a non-exclusive, non-transferable license to use the Service within the scope defined by the subscription.
10. Termination
The User may stop using the Service at any time by not renewing purchased subscriptions. Fees for any period during which the Customer does not use the Service are not refundable. After all Customer subscriptions expire, organization data is retained for 30 days before being permanently deleted.
The Provider may suspend operation of the Service in the event of a breach of these Terms or non-payment. The suspension may be carried out by blocking some or all licenses assigned to the Customer's organization. Operation of the Service will be restored after the reason for suspension ceases to exist.
11. Translations and Governing Language
Translations of content available in the system, including these Terms and other formal documents, were generated automatically and may contain linguistic or terminological imperfections. In case of interpretative discrepancies, the Polish-language documents prevail.
12. Final Provisions
These Terms are governed by Polish law. Any disputes shall be resolved by the court having jurisdiction over the Provider's registered office. If any provision of these Terms is found to be invalid, the remaining provisions shall remain in full force and effect.
